Please read the following Terms and Conditions (“Terms”) carefully, as they govern your access to and use of this Site.
If you do not agree with these Terms and Conditions, please exit the Site immediately. Otherwise, your access to and use of the Site will be deemed to constitute your acceptance of these Terms and Conditions.
NO VETERINARY ADVICE
This Site is provided for informational and educational purposes only. It does not contain information regarding all health conditions that may affect your pet, and the information provided may not be applicable to your pet’s individual circumstances.
The Site and the information contained herein are not intended to diagnose any condition, disease, or injury affecting your pet and should not be used as a substitute for advice from a licensed veterinarian.
HUIA shall not be responsible or liable for any injury, illness, death, or veterinary care costs resulting from failure to seek veterinary care or from reliance upon any information provided on this Site.
AUTHORIZED USERS
This Site is not intended for use by children under the age of 18. Minors who are above the age of 18 but are not legally considered adults in their jurisdiction of residence must obtain permission from a parent or legal guardian before accessing or using the Site.
By accessing or using the Site, you represent that you are legally permitted to do so under the laws applicable to you.
LIMITED LICENSE
If you accept and comply with these Terms, HUIA grants you a limited, non-exclusive, non-transferable license to access and use the Site for personal use or, where appropriate, for authorized business purposes.
This permission does not include the right to download, reproduce, modify, distribute, or create links to any portion of the Site or its content without prior written permission from HUIA.
For the purposes of these Terms, “Site Content” means any text, graphics, audio, video, data, interactive features, and/or other materials published on the Site or any page of the Site.
Unless otherwise indicated, HUIA owns or has obtained the necessary rights to license the Site Content for the uses permitted under these Terms.
The Site Content is protected to the fullest extent permitted under applicable Indian and foreign laws. Any unauthorized use of Site Content may constitute a violation of copyright, trademark, and other applicable laws.
Except as expressly permitted under these Terms, you may not store, distribute, display, sell, reproduce, modify, or otherwise use any Site Content.
You may occasionally print one copy of a page of the Site for your personal, non-commercial use; however, you may not make multiple copies for distribution to others.
Any violation of these Terms, including unauthorized use of Site Content, will immediately terminate the permission granted to you to access and use the Site and may result in legal action.
If you wish to use the Site or Site Content beyond the scope of this license, please contact HUIA for prior written permission.
USER-SUBMITTED CONTENT
The Site may provide you with an opportunity to submit content, including feedback, comments, photographs, personal stories, and other materials (“User Content”).
All communications you send to HUIA through personal accounts or other means, together with any documents, photographs, videos, or other materials associated with such communications, shall be considered User Content.
To submit User Content, you may be required to create an account and provide certain personal information, such as your name, email address, telephone number, residential or business address, and other relevant information.
For other methods of communication, creation of an account may not be required.
If you disclose personal information, our use of such information will be governed by our Privacy Policy, which is incorporated into these Terms by reference.
By submitting User Content to the Site, you grant HUIA a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, display, modify, adapt, create derivative works from, publish, and sublicense such User Content, including reposting such User Content on the Site.
This license also extends to your name, Site username, and profile information, where applicable.
HUIA reserves the right, but not the obligation, to review, refuse to display, restrict, or remove any User Content at its sole discretion and for any reason.
COPYRIGHT COMPLAINTS
HUIA respects the intellectual property rights of others and expects users of the Site to do the same.
HUIA may, in appropriate circumstances and at its sole discretion, terminate the rights of any Site user who infringes the intellectual property rights of HUIA or any third party.
The Copyright Act, 1957, as amended from time to time, provides legal remedies to copyright owners who believe that material available on the Internet infringes their rights.
If you believe that your copyrighted work has been copied in a manner that constitutes copyright infringement, or if you become aware of any person engaging in such activity, please contact HUIA and provide the following information:
A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner;
Identification of the copyrighted work allegedly infringed, or, where multiple copyrighted works are involved, a representative list of such works;
Identification of the allegedly infringing material or activity and sufficient information to enable us to locate the material on our Site;
Your name, postal address, telephone number, and email address;
A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its representative, or applicable law; and
A statement that the information provided in your notification is accurate and, under applicable law, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
If you have a good-faith belief that a copyright infringement notice has been wrongly filed against you, you may submit a counter-notification to HUIA in accordance with the Copyright Act, 1957.

ACCOUNTS AND COMMUNICATIONS
If you create an account to access certain portions of the Site or to submit User Content, you agree to use your account solely for your own authorized use.
When creating an account, you must not:
Impersonate another person;
Create an account on behalf of another person without authorization;
Provide an email address belonging to another person;
Create more than one account for yourself; or
Provide false or misleading information.
By providing your email address and/or mobile telephone number when creating an account, you agree that HUIA may contact you regarding changes to the Site, new information, HUIA products or services, or other purposes reasonably related to the operation of the Site.
You may opt out of promotional or other communications at any time by following the unsubscribe instructions provided in such communications.
You are solely responsible for maintaining the confidentiality of your account information, including your user ID, password, and/or security questions.
You are also responsible for all activities conducted through your account, whether or not such activities were performed by you.
You agree to notify HUIA immediately if you become aware of or suspect any unauthorized use of your account or any security breach, including loss, theft, or unauthorized disclosure of your password.
PROHIBITED ACTIVITIES
You may not use the Site to:
Stalk, harass, threaten, or otherwise interfere with another Site user or HUIA employee;
Impersonate any person or entity or falsely state or misrepresent your affiliation with HUIA or any other person or entity;
Harm minors in any manner or attempt to obtain personal information from minors;
Request, collect, publish, or attempt to obtain personal data of other Site users, including usernames or passwords;
Access or attempt to access another user’s account without authorization;
Reverse engineer, decompile, data mine, record, scrape, link to, collect information from, or otherwise manipulate any portion of the Site or its content;
Submit User Content that infringes any copyright, trademark, patent, trade secret, or other intellectual property right of any person or entity;
Submit confidential or proprietary information belonging to another person or entity;
Submit User Content that violates the legal rights of any person or entity;
Submit unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, indecent, hateful, racially or ethnically offensive, or otherwise objectionable content;
Submit unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or other forms of commercial solicitation; or
Submit User Content containing software viruses or other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of computer software, hardware, telecommunications equipment, or other systems.
INDEMNIFICATION
By accepting these Terms and using the Site, you agree to indemnify, defend, and hold harmless HUIA, its suppliers, licensors, partners, and their respective officers, directors, employees, agents, and representatives from and against any claims, demands, liabilities, losses, damages, costs, and expenses, including reasonable legal fees, arising out of or relating to:
Your access to or use of the Site;
Your violation of these Terms;
Any claim involving defamation, damage to property, personal injury, or death;
Your direct or indirect use, inability to use, or misuse of the Site or any products or services made available through the Site;
Any infringement of intellectual property or other rights of any person or entity by you or any third party using your account; and/or
Your violation of any applicable local, state, or national law or regulation.
HUIA reserves the right, at your expense, to assume exclusive control and defense of any matter for which you are required to indemnify HUIA.
You agree to cooperate fully with HUIA in the defense of any such claim and agree not to settle any matter without the prior written consent of HUIA.
HUIA will make reasonable efforts to notify you promptly upon becoming aware of any such claim, action, or proceeding. However, any failure or delay in providing such notice will not waive HUIA’s right to indemnification.
DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
The Site and all products, services, content, materials, and other information made available through the Site are provided “as is” and “as available,” without warranties of any kind, whether express or implied.
To the fullest extent permitted by applicable law, HUIA disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, compatibility, security, accuracy, and non-infringement.
Neither HUIA nor its respective licensors, licensees, service providers, or suppliers warrants that the Site or any functionality contained therein will be uninterrupted or error-free, that defects will be corrected, or that the Site or its servers are free from viruses or other harmful components.
Any products, offers, materials, or data downloaded or otherwise obtained through the Site are accessed and used at your own risk.
You are solely responsible for any damage to your computer system or loss of data resulting from downloading or otherwise obtaining such products, offers, materials, or data.
HUIA and its licensors, licensees, service providers, and suppliers make no representation or warranty regarding the completeness, accuracy, reliability, or results of the use of any products, offers, content, or materials available through the Site.
To the fullest extent permitted by applicable law, HUIA and its affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, goodwill, use, data, or other intangible losses, arising from or relating to:
Your use of or inability to use the Site;
The use of any content or other materials available on the Site or linked websites;
The purchase or acquisition of substitute goods or services resulting from goods, data, information, services, messages, or transactions obtained through the Site;
Unauthorized access to or alteration of your transmissions or data;
Any statement or conduct of a third party on the Site; or
Any other matter relating to the Site.
To the extent permitted by applicable law, HUIA’s total aggregate liability for all damages, losses, and causes of action, whether arising in contract, tort, negligence, or otherwise, shall not exceed INR 100 (One Hundred Indian Rupees) or the amount paid by you to HUIA during the preceding twelve (12) months, whichever is higher.
If you are dissatisfied with any portion of the Site or with any provision of these Terms, your sole and exclusive remedy is to discontinue use of the Site.
If any portion of this limitation of liability is found to be invalid or unenforceable, liability shall be limited to the maximum extent permitted by applicable law.
TERMINATION
HUIA reserves the right, at its sole discretion and without prior notice or liability, to terminate or suspend your account or your ability to access or use the Site, in whole or in part.
You may terminate these Terms at any time by closing your account and discontinuing use of the Site.
Upon termination by you or HUIA, your obligations to indemnify HUIA, as set forth in these Terms, shall survive and remain fully effective.
GOVERNING LAW AND JURISDICTION
These Terms and the relationship between you and HUIA shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict-of-law provisions.
Unless expressly waived by HUIA, you agree to submit to the personal and exclusive jurisdiction of the competent courts located in India.
Notwithstanding any applicable law to the contrary, any claim or action arising out of or relating to the use of the Site or these Terms must be filed within one (1) year from the date on which the claim or cause of action arose, unless a longer period is required by applicable law.
In any action brought to enforce or interpret these Terms, the prevailing party may be entitled to recover applicable legal costs and reasonable attorneys’ fees, to the extent permitted by law.
MISCELLANEOUS
These Terms, together with the Privacy Policy, constitute the entire agreement between you and HUIA concerning the subject matter hereof and supersede any prior agreements between you and HUIA relating to the same subject matter.
If any provision of these Terms is found to be unlawful, invalid, or unenforceable for any reason, that provision shall be deemed severable from these Terms and shall not affect the validity or enforceability of the remaining provisions.
Nothing in these Terms creates or establishes an agency, partnership, joint venture, employment, or other similar relationship between you and HUIA.
You have no authority to bind HUIA in any manner.
HUIA may assign or transfer its rights and obligations under these Terms, and these Terms shall be binding upon and benefit the respective successors, assigns, and permitted licensees of the parties.
HUIA’s failure to insist upon or enforce strict performance of any provision of these Terms, or its failure to exercise any right under these Terms, shall not constitute a waiver of such provision or right.
Any provision or right shall remain fully effective unless expressly waived in writing by HUIA.
HUIA may modify these Terms by publishing revised Terms on the Site or through a written agreement between the parties.
Each time you access or use the Site, you will be deemed to have accepted the Terms then in effect.
TRADEMARKS
Grant of Non-Exclusive License
HUIA grants a non-exclusive, non-transferable, and non-sublicensable license to use HUIA trademarks solely for the purpose of promoting HUIA products, subject to these Terms and HUIA’s applicable trademark policies.
Any use of HUIA trademarks shall comply with the trademark guidelines and policies issued by HUIA from time to time.
The promoter shall cooperate with HUIA in monitoring and controlling the nature and quality of the use of HUIA trademarks and shall promptly provide HUIA with copies of all materials in which the promoter uses any HUIA trademark upon request.
The promoter agrees to include the appropriate trademark symbol, “®” or “™,” whenever using a HUIA trademark, as applicable.
The promoter shall not place any additional trademark, logo, designation, or other mark on HUIA products other than those authorized by HUIA and shall not use any HUIA trademark on products other than HUIA products.
All use of HUIA trademarks shall be for the benefit of HUIA.
The promoter acknowledges that no payment has been made to HUIA for the use of HUIA trademarks and that nothing contained in these Terms grants the promoter any ownership or other proprietary rights in any HUIA trademark.
The original labeling of HUIA products must not be removed, concealed, enhanced, altered, modified, or supplemented in any manner unless required by applicable law and, where applicable, subject to HUIA’s prior written approval.
When promoting HUIA products, the promoter shall comply with HUIA-approved labeling guidelines and marketing materials and shall ensure that all promotional claims are consistent with claims authorized by the applicable governmental or regulatory authorities.
